• 10. Miscellaneous Provisions
  

  These Terms of Service will be governed by and construed in accordance with the laws of the State of Alabama, without giving effect to its conflict of laws provisions or your actual state or country of residence. If for any reason a court of competent jurisdiction finds any provision or portion of the Terms of Service to be unenforceable, the remainder of the Terms of Service will continue in full force and effect.

  These Terms of Service constitute the entire agreement between the parties with respect to the subject matter hereof and supersedes and replaces all prior or contemporaneous understandings or agreements, written or oral, regarding such subject matter. You may terminate your Membership at any time, for any reason, by following the instructions on the Member's Account Settings page. Moore Business Enterprise LLC. may terminate your Membership at any time, without warning. Even after Membership is terminated, this Agreement will remain in effect, including sections 5-17.

• 3. Fees. Currently there are no fees to use nearly all of Moore Business Enterprise LLC services. You acknowledge that Moore Business Enterprise LLC. reserves the right to charge for the Moore Business Enterprise LLC. Services and to change its fees from time to time in its discretion. If Moore Business Enterprise LLC. terminates your Membership because you have breached the Agreement, you shall not be entitled to the refund of any unused portion of subscription fees, prorated accordingly.

• 4. Password. When you sign up to become a Member, you will also be asked to choose a password. You are entirely responsible for maintaining the confidentiality of your password. You agree not to use the account, username, or password of another Member at any time or to disclose your password to any third party. You agree to notify Moore Business Enterprise LLC. immediately if you suspect any unauthorized use of your account or access to your password. You are solely responsible for any and all use of your account.

• 5. Non-commercial Use by Members. The Moore Business Enterprise LLC. Services are for the personal use of Members only and may not be used in connection with any commercial endeavors except those that are specifically endorsed or approved by Moore Business Enterprise LLC. Illegal and/or unauthorized use of the Moore Business Enterprise LLC. Services, including collecting usernames and/or email addresses of Members by electronic or other means for the purpose of sending unsolicited email or unauthorized framing of or linking to the Moore Business Enterprise LLC. Commercial advertisements, affiliate links, and other forms of solicitation may be removed from Member profiles without notice and may result in termination of Membership privileges. • 10. HOW WE MAY USE INFORMATION YOU PROVIDE TO US: Do not send us any confidential or proprietary information. Except for any personally identifiable information that we agree to keep confidential as provided in our Privacy Policy, any material, including, but not limited to any feedback, data, answers, questions, comments, suggestions, ideas or the like, which you send to us will be treated as being non-confidential and nonproprietary.   • F. solicits personal information from anyone under 18;

  • G. promotes information that you know is false or misleading or promotes illegal activities or conduct that is abusive, threatening, obscene, defamatory or libelous;

  • H. promotes an illegal or unauthorized copy of another person's copyrighted work, such as providing pirated computer programs or links to them, providing information to circumvent manufacture-installed copy-protect devices, or providing pirated music or links to pirated music files;

  • I. involves the transmission of "junk mail," "chain letters," or unsolicited mass mailing, instant messaging, "spimming," or "spamming";

As a reasonable estimation of such harm, you agree to pay Moore Business Enterprise LLC. $49 for each such unsolicited email or other unsolicited communication you send through the Moore Business Enterprise LLC.   • D. any automated use of the system, such as using scripts to add friends or send comments or messages;

  • F. attempting to impersonate another Member or person;

  • G. for band profiles, copying the code for your Moore Business Enterprise LLC. Player and embedding it into other profiles or asking other Members to embed it into their profiles;

  • H. using the account, username, or password of another Member at any time or disclosing your password to any third party or permitting any third party to access your account;

  • I. selling or otherwise transferring your profile;

  • J. using any information obtained from the Moore Business Enterprise LLC. Services in order to harass, abuse, or harm another person;

  • K. using the Moore Business Enterprise LLC. Services in a manner inconsistent with any and all applicable laws and regulations.
